Terms and Conditions – “The Face of QJAM 2012.”
1. The promoter is QJAM Entertainment Pty Ltd (ABN 83 153 126 188) of 299 Ruthven Street, Toowoomba Queensland 4350
2. Information regarding prizes and how to enter, forms part of these terms and conditions. By entering this promotion, entrants accept these terms and conditions.
3. This promotion commences at 12pm AEST on 24 December 2011 and closes at 12pm AEST on 10 February 2012 (“promotion period”).
4. Entry is open to Australian residents aged 14 to 25 years of age (other than directors, managers, employees (and their immediate families) of the promoter and its related companies, agencies of QJAM Entertainment Pty Ltd. Individuals aged between 14 and 17 years (inclusive) must have the permission of their parent or guardian to enter.
5. To enter, an eligible individual must complete and submit an online entry form at www.qjam.com.au/competition/face during the promotion period. Limit 1 entry per person. Incomplete, indecipherable, damaged or late entries will be deemed invalid. No responsibility will be accepted by the promoter for late, lost, damaged or misdirected entries. Individuals are responsible for any costs associated with accessing the promotional website which may be dependent on the Internet service provider used.
6. When submitting entries, entrants must leave their personal details including their full name, address, mobile telephone number, email address, age, date of birth and provide a response, in 25 words or less, to the question: “Why do you want to be The Face of QJAM 2012?” (“Question”).
7. The top five male and female entries will be shortlisted for an interview to asses suitability to be “The Face of QJAM 2012.”
8. Entries will be judged by a panel of the promoter’s marketing, dance and communications personnel (“Panel”). The Panel will decide which entries contain the first and second most relevant, creative and inspiring responses to the Question (“Winning Answers”). All decisions of the Promoter and the Panel are final and no discussions or correspondence will be entered into.
9. The winners (one male and one female) will be announced and notified by telephone and email on 12 February 2012.
10. Prize does not include spending money; insurance; or any other ancillary costs. Winners aged between 14 and 17 years old (inclusive) must be accompanied by their parent or guardian when redeeming their prize.
11. If a winner does not claim a prize within 3 days of being announced or is unable or unwilling, that individual may be deemed by the promoter as ineligible to receive the prize. The promoter will then reconvene the Panel to determine the next most relevant, creative and inspiring response to the Question and the entrant who submitted that entry will be deemed the replacement winner.
12. A 12 month agency contract will be raised after the winner has been announced. If the winner does not sign the ‘QJAM Agency contract’ the promoter will then reconvene the Panel to determine the next most relevant, creative and inspiring response to the Question and the entrant who submitted that entry will be deemed the replacement winner.
13. Prizes are not transferable or exchangeable and cannot be redeemed for cash. The promoter accepts no responsibility for any variation in the value of prizes. Where a prize is unavailable for any reason, the promoter may substitute that prize for another item of equal or higher value as determined by the promoter.
14a. Prizes MALE: QJAM Entertainment scholarship to the value of $2000 (prize includes all classes including performing arts and fitness; excluding crew training); QJAM Agency talent/modelling contract, ending at 12pm AEST Dec 31 2012. Winner will feature model for QJAM Entertainment advertising, tv commercial and print media at the discretion of QJAM Entertainment (contract does not guarantee work outside QJAM Entertainment); 1 x photographic fashion portfolio (prize includes portfolio and CD); Style make-over with Hair artist Kay Dickerson (includes styling for all QJAM commercial and media events); SNAP Fitness three month membership with three personal training sessions.
14b. Prizes FEMALE: QJAM Entertainment scholarship to the value of $2000 (prize includes all classes including performing arts and fitness; excluding crew training); QJAM Agency talent/modelling contract, ending at 12pm AEST Dec 31 2012. Winner will feature model for QJAM Entertainment advertising, tv commercial and print media at the discretion of QJAM Entertainment (contract does not guarantee work outside QJAM Entertainment); 1 x photographic fashion portfolio (prize includes portfolio and CD); Style make-over with Hair artist Kay Dickerson (includes styling for QJAM commercial and media events); Glam make-up make-over with Aaron Faour (includes make up for QJAM commercial and media events)
15. The promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the maximum extent permitted by law).
15. Without limiting clause 15, the promoter and its associated agencies and companies will not be liable for any damage to any prize.
16. If this promotion is interfered with in any way or is not capable of being properly conducted due to any reason beyond the reasonable control of the promoter, the promoter reserves the right in its sole discretion, and to the maximum extent permitted by law, to disqualify any entrants and to modify, suspend, terminate or cancel this promotion, as appropriate.
17. All entries will be the property of the promoter. Personal information provided by entrants will be used by the promoter for the purpose of conducting this promotion and otherwise in accordance with entrants’ consent. The promoter may disclose entrants’ personal information to its panel and agents to assist in conducting this promotion.
